Solicitation for Services
The State of Nevada is seeking expressions of interest of law firms in providing representation on behalf of the State before the Nuclear Regulatory Commission (NRC). The Nuclear Waste Policy Act of 1982, as amended, directs the U.S. Department of Energy to conduct site characterization studies at the Yucca Mountain site in southern Nevada to determine it's suitability for development as a repository, and if found suitable, to prepare a license application to be submitted to the NRC for a construction authorization and subsequently a license to receive and possess certain nuclear materials for disposal in a Yucca Mountain repository.
The State of Nevada has been conducting oversight activities regarding the Department of Energy site characterization studies as well as conducting independent studies regarding certain aspects of the site and program since 1982. As a result of these studies, the State of Nevada intends to rigorously oppose any attempt by the Department of Energy to find Yucca Mountain suitable for development and ultimately oppose any attempt to secure a license to receive a construction authorization from the Nuclear Regulatory Commission.
Therefore, we seeking expressions of interest from law firms that have experience before the Nuclear Regulatory Commission in representing the State of Nevada as described above. Firms interested in said representation should include in their expression interest detailed experience history before the NRC, schedule of rates, identify and explain any possible conflicts, including representation on behalf of the Department of Energy, or any nuclear utility. The State of Nevada will determine if such conflicts would affect any future relationships.
The State anticipates acquiring the aforementioned services mid to late summer 2001, as various meetings and other pre-licensing interactions and activities are ongoing, and the firm selected will be required to begin immediately become involved in these activities on behalf of the State.
