The U.S. Justice Department has filed a brief in U.S. District Court asking that a lawsuit filed last month against the Nuclear Regulatory Commission be dismissed because it was filed in the wrong court.

The group, which includes the Grand Canyon Trust and Grand County, filed the suit in U.S. District Court in Salt Lake City to stop the NRC from approving a plan to cap uranium mill tailings where they are piled on the banks of the Colorado River north of Moab.

The Justice department says all administrative avenues to settle the dispute must first be exhausted. If an agreement cannot be reached then the group can file an appeal with the 10th U.S. Circuit Court of Appeals in Denver.
