A. There is no time restriction regarding when you can sell, but Recapture has to be addressed if the residence is sold within the first 9 years of the mortgage loan.
Q. Under Recapture will I have to pay all my equity to the Nevada Housing Division when I sell my home?
A. No. Recapture Tax is a Federal Income Tax and is reported to IRS when you file your taxes. Recapture tax can never exceed 100% percent of the Federally Subsidized Amount (original loan amount times .0625) or 50% of the gain realized, whichever is less.
Q. Is my loan assumable?
A. Yes. However, a new borrower must meet Nevada Housing Division guidelines in order to qualify.
